Terms of Service

These Terms govern your use of School Proofing, a records platform for alternative education operated by Joticle, Inc., a Delaware corporation ("we", "us"). By creating an account or using the service you agree to them. If you are agreeing on behalf of a school, co-op, umbrella school or other organisation, you confirm you have authority to bind it.

1. What School Proofing is

School Proofing helps families and schools capture daily learning and turn it into records — subject hours, attendance, reading logs, portfolios and documentation used for state compliance and education savings account (ESA) programs.

We are a records platform, not a legal or educational authority. We do not provide legal advice, and we do not determine whether you have met your state's requirements. State law changes, is interpreted differently by different authorities, and ultimately applies to you rather than to us. You remain responsible for meeting your own obligations, for the accuracy of what you record, and for what you submit to any state agency or ESA program.

2. Accounts and eligibility

You must be at least 18 to create an account. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity that happens under your account.

Student access works in one of three ways, chosen by the responsible adult:

• Family-linked — the student has no separate sign-in, and a parent acts on their behalf.
• Student sign-in — a parent creates a username and PIN for the student.
• Independent student — a student aged 13 or older holds their own email and password.

Creating a sign-in for a student under 13 requires verifiable parental consent, which we record. See the Privacy Policy for how children's information is handled.

3. Your content

Journal entries, attachments, documents, student records and everything else you put into School Proofing remain yours. For school and organisation customers, education records remain the customer's; we process them on your instruction.

You grant us the limited licence needed to run the service — to store, process, display and back up your content, to generate summaries, classifications and documents from it, and to share it where you direct us to. That licence exists only to operate the service and ends when you delete the content or close your account.

We do not sell your content, and we do not use student-identifiable content to train external AI models.

4. Acceptable use

You agree not to:

• upload content you have no right to share, or that is unlawful or harmful;
• use the service to submit information you know to be false to a state agency or ESA program;
• attempt to access another family's or organisation's records;
• probe, scan or interfere with the service or its security;
• resell or redistribute the service without our written agreement;
• use automated means to extract data at a scale that degrades the service for others.

We may suspend accounts that put other customers' data or the service at risk.

5. Subscriptions, trials and billing

Paid plans are billed in advance through our payment processor. New accounts may start with a free trial; unless you cancel before it ends, the plan converts to paid at the price shown when you signed up.

• Cancelling — you may cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Refunds — we do not automatically refund partial periods. If something has gone wrong, contact us; we would rather sort it out than argue about it.
• Price changes — we will give at least 30 days' notice before a change affects your renewal.
• Failed payment — we may limit the account to read-only access until payment succeeds, so your records stay reachable.

6. AI-generated content

Parts of the service use AI to classify entries into subjects, estimate time, read receipts, and draft summaries and portfolio narratives. These outputs are informational and can be wrong. They are a starting point, not a finding.

Review anything produced by these features before relying on it, and especially before submitting it to a state agency, an ESA program or an auditor. You can edit or override any AI-generated classification or summary.

7. Availability and changes

We aim to keep the service available and to improve it continuously, which means features change. We may modify or discontinue parts of the service; where a change would materially reduce what you rely on, we will give reasonable notice. We do not promise uninterrupted or error-free operation.

8. Ending the agreement, and getting your data out

You may close your account at any time. We may suspend or terminate an account for a material breach of these Terms, for non-payment, or where required by law — with notice where we reasonably can give it.

Your records do not disappear the moment you leave. You can export your data while your account is active, and for at least 30 days after it closes you can contact us to request an export. After that, data is deleted on the timeline in the Privacy Policy.

9. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that use of School Proofing will result in compliance with any state law, approval of any ESA application or reimbursement, or acceptance of any record by any authority.

10. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from these Terms or the service.

Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, in which case the above applies to the maximum extent permitted.

11. Indemnity

You agree to indemnify us against third-party claims arising from your content, your use of the service in breach of these Terms, or your violation of law or of another person's rights.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Before starting formal proceedings, please contact us — most disputes are quicker to resolve directly.

13. Changes to these Terms

We may update these Terms. When a change is material we will give notice through the service or by email before it takes effect, and the effective date at the top of this page will change. Continuing to use the service after that means you accept the updated Terms.
